Day 1 Arguments: 26th October, 2018

On 24th October, Common Cause filed a petition challenging the Centre's decision to divest CBI Director Alok Verma of his powers and send him on leave in view of the infighting between him and Special Director Rakesh Asthana.

 

Today, a three-judge Bench comprising CJI Ranhan Gogoi, Judges SK Kaul and KM Joseph gave two weeks to the Central Vigilance Comission (CVC) to complete its probe into CBI Director Alok Verma. The Bench ordered the probe to be monitored by retired Supreme Court judge AK Patnaik.

 

Summary of the Supreme Court order:

  • the CVC to complete the investigation within two weeks of 26th October, under the supervision of retired Justice AK Patnaik
  • all actions taken by Interim Director until the next hearing have to be submitted to the court in a sealed cover. This will include decisions consisting the transfer of investigation and change of officers.
  • the Interim Director cannot take any policy actions till the issue is decided

 

The Court will hear the matter next on 12th November.
